Terms & Conditions of Electric Service

  • The Applicant will deposit with FKEC such sums as may be required from time to time by it which will be held as a billing guaranteed deposit. Such deposit will be applied to any unpaid amount at the time of discontinuance of service and the balance returned to the member. Said billing deposit shall be in an amount determined by the Cooperative to be necessary to guarantee payment of bills rendered to member, as provided by the Bylaws of the Cooperative, and said billing deposit shall secure payment not only of the above account, but any other delinquent accounts of the member.
  • The Applicant will purchase from FKEC all electric energy used on the premises described below or at any other premises of the member for which service is required. The applicant will pay for this service on a monthly basis at rates to be determined from time to time in accordance with the applicable Bylaws and policies of FKEC. FKEC may limit the amount of electric energy to be furnished for industrial purposes.
  • The Applicant will cause the premises to be wired in accordance with all applicable local codes, regulations, and specifications and will furnish proof of such compliance prior to installation of service by FKEC. The Applicant agrees to maintain these code standards and to maintain clearance as provided by the National Electrical Code.
  • The Applicant will comply with and be bound by the provisions of the Charter and Bylaws of FKEC of which he will be a member, and such rules, regulations and policies as may from time to time be adopted by FKEC.
  • The Applicant, by becoming a member of FKEC, assumes no personal liability or responsibility for any debts or liabilities of FKEC, and it is expressly understood that under law his property cannot be attached for any such debts or liabilities.
  • The Applicant agrees to pay the monthly bill for electricity which shall become due and owing at such time it is rendered. If it is necessary to discontinue service or call at the Applicant's location for collection because of non-payment of a bill or to reconnect an account during regular business hours if service has been discontinued or reconnection is requested after regular business hours or on Saturday, Sunday or a legal holiday, the appropriate fee approved by the Board of Directors will be paid by the Applicant. If the account becomes 30 days or more delinquent, FKEC may require an additional guarantee deposit which the Applicant agrees to make. If the delinquent bill plus charges and/or the additional deposit is not paid after request for payment, electric service shall be discontinued.
  • The Applicant hereby grants an easement and a license to FKEC through and across the premises for which electric service is being supplied for the purpose of constructing and maintaining the necessary electric lines, equipment and appurtenances to furnish the service required on said premises to the extent that it is necessary and convenient for FKEC to enter upon said premises for said purposes. Said easement and license shall grant to FKEC the right to trim trees and shrubbery which, in the opinion of FKEC, are interfering with their electric lines or in any manner interfering with electrical service provided by FKEC.
  • The acceptance of this Application by FKEC after signature by the Applicant shall constitute a contract between the Applicant and FKEC.
  • In the event the monthly bill for electricity used at the time such bill is rendered is not paid in addition to the remedies given to FKEC in paragraph No.6, above, if it becomes necessary for FKEC to institute any collection proceedings in order to obtain payment of any unpaid bill, the Applicant agrees to pay all costs of collection, including reasonable attorney's fees and reasonable costs incurred to any collection agency for such collection, whether suit be brought or not.
  • Applicant, as a member of FKEC, may be at various times and in accordance with the Bylaws of FKEC, entitled to cash retirements of Capital and Credits, return of deposit or other payments due the Member from FKEC. Said payments shall be made according to said Bylaws and policies and resolutions of the Board of Directors and paid to Applicant at his or her last address furnished by Applicant to FKEC. If said payment is not received or claimed within 5 years, or within such other period as may be provided by the Bylaws of the Cooperative, after such payment has been made available to Applicant by notice or check mailed to Applicant at the last address so furnished, then Applicant agrees that the amount of such sums due shall automatically constitute an irrevocable assignment and gift by such Member of FKEC provided further that on the expiration of the end of the 5 year period or any other period said Bylaws may provide that notice by mail or publication shall then be given said Applicant at such last known address or notice by publication by one insertion in a newspaper circulated in the service area of FKEC which may be its newsletter. Sixty days from giving of said notice by either method, or for any other period or method of notice as may be provided by said Bylaws, said irrevocable assignment or gift shall become absolute.
  • In the event the electric meter or any equipment of the Cooperative is installed on the member's property at an elevation below the 100 year flood level established by the United States Army Corps of Engineers, or any other federal agency having jurisdiction to do so, the member acknowledges that said meter and electrical equipment installed at the risk of the member and should same be damaged or destroyed as a result of rising water occurring through a natural calamity, that the reinstallation of said meter and electrical equipment shall be at the expense of the member and the Cooperative reserves the right to require the cost of same be paid in advance prior to reinstallation of said equipment.
  • Service to the electrical equipment controlled by load management devices installed on the member's premises may be interrupted. FKEC shall be allowed reasonable access to the member's premises to install, maintain, inspect, test and remove load management devices on the electrical equipment.
  • Formal acceptance of this application shall be made by FKEC in accordance with provisions contained in said bylaws.
